Who can witness my Will?

Witnessing your Will is the final stage of ensuring your Will is legally binding, so getting it right is extremely important.

Essentially, anyone can witness your Will, as long as they are of sound of mind, over the age of eighteen and are not blind. However, asking spouses, family members, spouses of your family members or beneficiaries is not recommended and can cause issues once you have passed away.

Choosing independent witnesses will ensure there is no delay in the administration of the estate and we recommend choosing friends, work colleagues or neighbours. However, if Penguin Legal has drafted your Will then we will act as your witnesses making the process easier and simpler.
